Arrests In Weapons Case

Brandishing a weapon resulted in the arrest of two people in Escalon on Tuesday evening, Sept. 1 with one of the men jailed on felony charges.

Police said that they received a report from a victim that the driver of a blue Ford Mustang brandished a firearm at him in the area of Highway 120 and McHenry Avenue on Tuesday evening, about 9:15 p.m. Officer Armendariz responded and subsequently located the vehicle in the 1200 block of Plaza Avenue and initiated a felony traffic stop as it was about to enter the Burger King drive through.

The driver, a 19-year-old from Escalon, was taken into custody without incident on a misdemeanor count of brandishing a weapon and for driving without a license. The passenger, identified as Elias Padilla, 35, from Escalon resisted the officers and was subsequently Tased. A pellet gun was located in the vehicle. Police said the BB gun did not have a red tip on it so it appeared as though it was a larger caliber weapon as opposed to a pellet gun.

Padilla was charged with obstruction of justice for resisting officers and, after a search was conducted, officers found a knife in his pocket, so he was additionally charged with a felony count of carrying a concealed dirk or dagger.

Both men were booked into San Joaquin County Jail. The 19-year-old was later released after posting bond but Padilla, as of Monday night, was still being held on $23,000 bail pending further court action.
